Article 1 (Purpose)
These Terms set out the conditions and procedures for using the dedicated static IP service
and the cloud server service (together, the "Service") provided by SMART SN Co., Ltd.
(the "Company"), and the rights and obligations of the Company and the customer.
Chapter 1 applies to both services.
Chapter 2 applies only to the cloud server service, and where it differs from Chapter 1, Chapter 2 prevails.
Article 2 (Types and Nature of the Service)
The Company provides the following services.

Dedicated static IP service — the Company leases a public IP address, allocated to it by a Korean
telecommunications carrier, exclusively to a single customer. The customer connects to the internet through
an encrypted tunnel using the address assigned to them.
- The address assigned is a public IP address on a Korean carrier line, not a data centre range.
- The assigned address is used only by that customer and is not shared with others.
- The service is provided on a verified-identity basis and is not intended for anonymous access.
- Its purpose is to remove the restrictions customers encounter when accessing Korean services from abroad.

Cloud server service — the Company configures part of the physical resources in a Korean data centre
as a virtual server and provides it to the customer. The customer operates the server directly with
administrator (root) privileges. Details are set out in Chapter 2.
Article 3 (Definitions)
- Dedicated static IP — a public IP address assigned to one customer only and unchanged during the subscription period
- Cloud server — a virtual server made up of the vCPU, memory and disk allocated to the customer
- Account — the identifier and credentials used to connect to the Service
- Subscription period — the period during which the Service may be used under the plan paid for
Article 4 (Effect and Amendment of these Terms)
- These Terms take effect when posted on the Service's pages.
- The Company may amend these Terms where necessary, giving notice on the Service's pages and by email from 7 days before the effective date (30 days before for amendments unfavourable to customers).
- If you do not agree to an amendment you may terminate your agreement. If you continue to use the Service after the notice period has passed, you are taken to have accepted the amendment.
Article 5 (Refund of the First Payment)
This Article applies only to the dedicated static IP service.
- The Company does not offer a free trial.
- For the first term a customer pays for, the Company gives a full refund, with no reason required, on a request made within 7 days of payment.
- Paragraph 2 applies once per person and does not apply to renewals or to any later payment.
- All other refunds are governed by the Refund Policy.
Article 6 (Formation of the Agreement)
- The agreement is formed when the customer applies and the Company accepts.
- The Company may withhold or refuse acceptance in the following cases.
- The application contains false information
- There is insufficient IP or server capacity available
- The applicant has previously been suspended for breach of Article 11
- Misuse of a payment method is suspected
- Where capacity is insufficient the Company may place the application on hold, in which case no payment is taken.
Article 7 (Contents of the Dedicated Static IP Service)
- The Company assigns one dedicated static IP and provides connection credentials.
- The connection protocol may be chosen from those the Company offers.
- The service may be used on one device per account.
- Where the assigned IP is blocked by a particular site, the Company will replace the IP within the number of replacements included in the plan. Reconnection is required after a replacement, and connection details may change if the line has to be moved.
- The Company does not guarantee access to every site. Access may be restricted by the policies of individual service providers.
Article 8 (Charges and Payment)
- Charges are those shown on the Service's pages.
- At the end of a subscription period the plan renews automatically on the same terms, and the Company gives notice of the renewal amount and how to cancel 7 days before renewal. Automatic renewal can be stopped at any time from My Service.
- Where charges change, the amount for a period already begun does not change.
- If payment is not confirmed, a 7-day grace period applies, during which access continues.
Article 9 (Suspension and Restriction of the Service)
- The Company may suspend or restrict the Service in the following cases.
- Equipment inspection, repair or replacement is required
- An event beyond the Company's control occurs, such as a carrier line failure
- The customer has breached Article 11
- Payment is not confirmed by the end of the grace period in Article 8
- Planned maintenance is notified in advance. In urgent cases notice may be given afterwards.
- Where use is suspended for non-payment, the assigned IP is held for a period, and paying within that period restores the same IP. For cloud servers, Article 20 applies.
Article 10 (Termination)
- The dedicated static IP service can be terminated directly from My Service. No phone call or consultation is required. For the cloud server service, send a termination request to customer support and it will be processed.
- On termination you may use the Service until the end of the period paid for, and automatic renewal stops.
- The Company may terminate the agreement after prior notice where the customer has breached Article 11. In urgent cases the Company may suspend use first and give notice afterwards.
- On termination the assigned IP is reclaimed, and the same IP is not guaranteed if you subscribe again later.
- Refunds are governed by the Refund Policy, which forms part of these Terms.
Article 11 (Customer Obligations — Prohibited Conduct)
The following are prohibited, and use may be suspended without prior notice where they are identified.
- Sending spam or bulk messages without the recipient's consent
- Unauthorised access, port scanning or intrusion attempts against the systems of others
- Denial-of-service (DDoS) attacks and other conduct that disrupts networks
- Distributing or operating malware or phishing sites
- Distributing information in breach of applicable law
- Using another person's identity or payment method
- Sharing, transferring or reselling an account to a third party
- Using the assigned IP or server to infringe the rights of others
Where the Company receives an abuse report from a line provider, it may suspend use temporarily to establish the facts.
This is because one customer's abuse harms other customers on the same range.
Article 12 (Company Obligations)
- The Company works to provide the Service reliably.
- The Company protects personal data in accordance with the Privacy Policy.
- The Company does not inspect the contents of customer communications or data stored on servers. It does retain connection records needed for fault handling and abuse response (connection time, assigned IP, total traffic).
Article 13 (Limitation of Liability)
- The Company is not liable where it cannot provide the Service for reasons beyond its control, such as natural disaster or a carrier line failure.
- The Company is not responsible for the content or policies of third-party services the customer accesses through the Service.
- The Company is not liable for loss caused by the customer.
- Even where the Company is liable, compensation will not exceed the charges the customer paid for the period concerned. This limit does not apply where the Company has acted intentionally or with gross negligence.
Article 14 (Governing Law and Disputes)
- These Terms are governed by the laws of the Republic of Korea.
- Disputes are to be resolved by agreement between the Company and the customer; failing agreement, they are brought before the court having jurisdiction under the Korean Civil Procedure Act.
- Where consumer protection law in the customer's country of residence provides protection more favourable to the customer than these Terms, that law prevails.
Chapter 2 — Cloud Server Provisions
This Chapter applies only to the cloud server service.
Where it differs from Chapter 1, this Chapter prevails.
Article 15 (Contents of the Service)
- The Company builds a virtual server in a Korean data centre to the specification chosen by the customer (vCPU, memory and disk), and provides administrator (root) privileges and connection details.
- Provisioning takes place within 3 hours for Standard and High-performance products, and within 1 business day for Unmetered products. These times are based on orders received between 09:00 and 18:00 on business days, Korean time; orders received outside those hours are processed on the next business day.
- A basic firewall is provided at no charge.
- The operating systems available differ by product, and products with fewer than 2 vCPU support Linux operating systems only.
- After the operating system is installed, configuration, operation and security management are carried out by the customer. The Company does not intervene in the internal configuration of the server.
Article 16 (Charges and Subscription Period)
- Charges are monthly and are those shown on the Service's pages. Amounts shown in Korean won are exclusive of VAT.
- Once provisioned, charges apply even if the server is not actually used. This includes a server left powered off, because the resources remain allocated.
- To change specification, contact customer support. A reboot may be required during the change, and the difference in charges is settled.
- Where a change reduces disk capacity, data migration is required and is carried out as paid technical support.
- Operating systems and software requiring a paid licence, such as Windows Server, are charged separately, and prices may change in line with the vendor's policy. Licence charges are billed by the month even if used for less than a month.
Article 17 (Traffic)
- Standard products include 600 GB and High-performance products 1 TB of outbound traffic per month. Inbound traffic is not charged.
- Usage above the included amount is charged at KRW 100 per GB (excluding VAT), converted to the payment currency for payments made from outside Korea.
- You are notified when usage reaches 80% and 100%. The Service is not cut off merely because the included amount has been exceeded.
- Unmetered products have no cap on total traffic; the bandwidth set for each product acts as the practical ceiling.
- Services that generate large volumes of outbound traffic or become the target of DDoS attacks may be restricted in order to protect other customers.
Article 18 (Backup and Retention of Data)
- The duty to back up and retain all data stored on the server rests with the customer.
- By its nature a cloud server may lose data through hardware failure, external intrusion or ransomware infection.
- Backup is not included in the cloud server charge. If you need backup you must subscribe to a separate backup product.
- Even where a backup product is used, it improves the chance of recovery rather than guaranteeing it. The Company does not warrant that recovery from a backup will succeed.
- Keep important data in a separate location outside the server. Ransomware frequently encrypts backup copies attached to the server as well.
Article 19 (Customer Responsibilities)
- Because the customer operates the server with administrator privileges, the customer bears the licences for any software installed and the responsibility for its use.
- The customer must manage account details and access keys, and the Company is not liable for compromises arising from failure to do so.
- Where a customer's server is compromised and harms other customers or third parties, the Company may cut off that server's network to prevent the harm spreading. Notice is given without delay in such cases.
Article 20 (Suspension, Termination and Deletion of Data)
- Where charges are unpaid, or the service is deleted or terminated through the customer's fault, data may be impossible to recover.
- On termination the allocated resources and the data stored on the server are deleted. Please download anything you need before terminating.
- The Company accepts no responsibility for retaining or recovering data after termination.
Article 21 (Limitation of Liability)
- The Company is not liable for the disclosure, omission or loss of data arising from the causes set out in Article 18.
- Momentary degradation of input/output (I/O) performance is not treated as a failure and is excluded from compensation.
- Availability and compensation for failures are set out in the Service Level Agreement. Where it conflicts with these Terms, that agreement prevails.
- All other matters are governed by Article 13.
Addendum
- These Terms take effect on 3 August 2026.

The amended Terms take effect on 9 August 2026. Articles 1 and 2 were revised and Chapter 2 added
on the introduction of the cloud server service; the rights and obligations of existing dedicated static IP
customers are unchanged.

The amended Terms take effect on 13 September 2026. The one-day free trial was withdrawn, and
Articles 3 and 5 were revised so that the first term paid for is fully refundable within 7 days.
